Update on PPA-related Legal Actions

ENMAX agrees to request for adjournment of a technical matter related to the effective date of termination of the Battle River PPA

ENMAX Energy (ENMAX) has agreed to an adjournment requested by the Attorney General of Alberta on a technical matter before the Court regarding the effective date of termination of the Battle River 5 Power Purchase Arrangement (PPA).

ENMAX provided the Balancing Pool with notice of termination of this PPA effective January 1, 2016. On January 27, 2016, following its investigation, assessment and verification, the Balancing Pool confirmed ENMAX's entitlement to terminate the PPA.   The technical matter before the Court relates to a determination of the effective date of this PPA termination. The Balancing Pool's confirmation of the Battle River PPA termination by ENMAX is not in dispute in the action that has been adjourned. 

In order to be respectful of the Court's time, ENMAX agreed to adjourn this technical matter until after the matters before the Court in a separate and more complex Proceeding commenced by the Government of Alberta are heard.

ENMAX is eager to resolve the larger outstanding legal questions in the Government of Alberta's Court Proceeding.  We look forward to responding with the facts during the Court process.
