Our priority at ENMAX Power Corporation (EPC) is to provide safe and reliable power to our customers.
Unfortunately, there may be circumstances in which your power supply may be interrupted. While we apologize for any power disruptions, EPC is
not liable for any losses or damages resulting from a power outage – scheduled or unexpected.
Scheduled outages
While EPC will make every reasonable effort to provide notice of a planned power outage affecting your household or business, it is not liable for any losses or damages as a result of a scheduled outage such as maintenance or repairs.
EPC has the right, without any liability to customers, retailers, or any other person in law, equity, contract or tort, to de-energize or otherwise curtail, interrupt or reduce electricity services or any other service provided under these terms and conditions when:
a) EPC reasonably determines that such a de-energization, curtailment, interruption or reduction is necessary:
i) to facilitate the construction, installation, maintenance, repair, replacement or inspection of any of the facilities,
ii) to maintain the safety and reliability of EPC's electric distribution system, or a connecting entity's electrical system, or
iii) due to any other reason, including emergencies, forced outages, potential overloading of the electric distribution system or force majeure; or
b) EPC is directed to do so by the Independent System Operator (ISO).
Unexpected outages
EPC is
not liable for damage caused by incidents including, but not limited to:
- Acts of nature (e.g. rain, lightning, wind, snow)
- Animal interference (e.g. birds, squirrels)
- Unexpected equipment failure (including customer equipment failure)
- Fallen tree branches
- Damage to our infrastructure by third parties (e.g. vandalism, motor vehicles)
