Regulators

Alberta Energy and Utilities Board (EUB)

The fully independent EUB, a part of the Alberta government, regulates the safe, responsible, and efficient development of Alberta’s energy resources, including electrical energy – and the pipelines and transmission lines that move the sources to market. A primary EUB role is to adjudicate and regulate energy developments and utility rates, providing a public forum for people who may be interested by proposed developments and rate changes.

Regulatory approval of ENMAX Power was transferred from The City of Calgary to the EUB in January 2004. This is the regulated side of ENMAX’s business, and involves filing regulatory applications with associated tariffs to the EUB. These are examined and challenged in hearings that are open to the public.

Alberta Electric System Operator (AESO)

The AESO was created under the Electric Utilities Act to be responsible for the safe, reliable and economic planning and operation of the power grid in Alberta. It provides access to the grid for generation and distribution companies as well as for large industrial electricity consumers.  The AESO ensures system reliability through the procurement of ancillary services and manages settlement of the hourly wholesale market and transmission system services.  Under the oversight of the AESO, Alberta's electricity, both generated and imported, is pooled and sold to distributors and exporters in an active wholesale market.

Like the rest of the more than 200 participants in Alberta's competitive wholesale electricity market, ENMAX Energy and its subsidiaries are required to comply with the rules and operating procedures set by the AESO in their activities in the wholesale market.

The Market Surveillance Administrator (MSA)

The MSA is an independent body created under the Electric Utilities Act to help ensure the fair, efficient and openly competitive operation of Alberta's electricity markets. The Code of Conduct Regulation governs aspects of the retail electricity market, including the conduct of owners of electric distribution systems and affiliated retailers. Any person who feels that a contravention of this Regulation has occurred may submit a complaint to the MSA, by following the process set out in section 51 of the Act. Copies of this Act and Regulation may be obtained through the Queen's Printer (Alberta).

In addition to its responsibilities under the Code of Conduct Regulation, the MSA has the mandate to conduct surveillance and investigations of market participants and has the authority to recommend sanction of market participants for inappropriate market behaviour.

ENMAX Power and ENMAX Energy must comply with the Code of Conduct Regulation in their activities as distribution system owner, regulated rate provider and competitive retailer.  Additionally, ENMAX Energy and its subsidiaries who participate in the wholesale electricity market are subject to the MSA's surveillance and investigative activities regarding their behaviour in the wholesale market.
